Hermès’ lawsuit against the MetaBirkin creator Mason Rothschild alleging trademark infringement is going forward. Rothschild’s motion to dismiss Hermès’ complaint was denied earlier this year and he sought to appeal the decision at this early stage of the case. U.S. District Court judge Jed Rakoff recently denied the request to certify the appeal and affirmed that the lawsuit shall go forward on the merits.
